1. Acceptance of Terms & Scope
Welcome to Nalva ("we," "our," or "us"). These Terms of Service ("Terms" or "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and Nalva regarding your access to and use of the Nalva mobile application on iOS (the "App") and any associated services, interactive features, and content (collectively, the "Services").
By creating an account, downloading, browsing, or utilizing any portion of the Services, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms, as well as our accompanying Privacy Policy. If you do not agree with any provision set forth in these Terms, you must not access or use the App and must uninstall it immediately.
2. Strict Age Requirement & Eligibility (Strictly 18+ Only)
STRICT 18+ ADULT SERVICE MANDATE: Nalva is strictly and exclusively intended for individuals who are at least eighteen (18) years of age. Anyone under 18 years old is strictly prohibited from downloading, registering, accessing, or using this Application.
By using Nalva, you explicitly represent, warrant, and affirm under penalty of misrepresentation that:
You are at least 18 years of age and possess full legal capacity to enter into this binding Agreement under applicable laws.
You are not a minor in your jurisdiction of residence.
You have never been suspended, terminated, or permanently banned from Nalva for violations of community guidelines or applicable laws.
If Nalva discovers or is notified that any account is held or operated by an individual under the age of 18, we will immediately and without prior notice terminate the account, revoke access, and purge all associated data.
3. Account Registration & Account Security
To access community features, post outfits, and customize presets in the styling studio, you must register for an account:
Accuracy of Information: You agree to provide true, current, and complete information during registration (such as username, valid email, and age verification) and to maintain the accuracy of such details.
Credential Confidentiality: You are solely responsible for maintaining the confidentiality of your login credentials (passwords, authentication tokens). You agree not to disclose your password to any third party.
Responsibility for Activities: You accept full legal responsibility for all activities, posts, and communications that occur under your account credentials.
Notification of Breach: If you suspect any unauthorized access or breach of your account security, you must notify our support team immediately at service@nalva.org.
4. Limited License & Service Availability
Subject to your continuous compliance with these Terms, Nalva grants you a personal, revocable, non-exclusive, non-transferable, non-sublicensable limited license to install and use the App on iOS devices that you own or control, solely for your personal, non-commercial aesthetic and styling purposes.
We reserve the right at any time to modify, enhance, suspend, or discontinue any feature, preset library, or portion of the Services without liability to you. We do not guarantee continuous, uninterrupted, error-free operation of the App or real-time synchronization under poor network conditions.
5. Styling Studio, Wardrobe Presets & Platform IP
The second primary tab of Nalva provides an interactive virtual wardrobe studio containing digital garment items, layering canvas tools, and pre-styled combination templates:
Platform Intellectual Property: All default visual assets, clothing vector illustrations, 3D renderings, preset templates, canvas layout software, graphic UI elements, icons, trademarks, and trade dress within Nalva are the exclusive intellectual property of Nalva and its licensors.
Limited Interactive License: You may use, mix, layer, scale, and combine these digital clothing presets solely within the App interface and export rendered collage outputs solely for personal social sharing.
Prohibition of Extraction: You may not reverse engineer, decompile, extract, rip, scrape, sell, redistribute, or commercially exploit any digital clothing graphics, preset assets, or canvas software outside the authorized bounds of Nalva.
Nalva enables users to upload outfit photos (OOTDs), compose custom mix-and-match lookbook collages, write style reviews, author captions, and publish comments ("User-Generated Content" or "UGC"):
Ownership of Your Content: As between you and Nalva, you retain copyright and all proprietary ownership rights in the original outfit photos and textual commentary that you create and upload to Nalva.
License Granted to Nalva: By submitting, uploading, or posting UGC to public feeds or styling tabs within Nalva, you grant us a worldwide, royalty-free, perpetual, irrevocable, transferable, sublicensable license to host, store, display, reproduce, format, adapt, and distribute your content across our digital network solely for operating, promoting, and improving the Nalva community and styling features.
User Representations & Warranties: You represent and warrant that: (i) you own or have obtained all necessary permissions, licenses, and releases for all media you post; (ii) your UGC does not infringe, misappropriate, or violate any patent, copyright, trademark, privacy, publicity, or proprietary right of any third party; and (iii) your content complies strictly with Section 7 of these Terms.
7. Code of Conduct & Prohibited Activities
ZERO TOLERANCE POLICY: Nalva maintains a strict zero-tolerance policy against objectionable, abusive, defamatory, sexually explicit, harmful, or unlawful content and behavior.
You agree that you will NOT, under any circumstances, upload, publish, broadcast, message, or facilitate any content or conduct that:
Contains Obscene or Illicit Media: Depicts explicit sexual acts, pornography, non-consensual nudity, extreme violence, gore, or illegal activities.
Harassment & Hate Speech: Bullying, stalking, intimidating, defaming, disparaging, or promoting hate speech against any individual or group based on race, ethnicity, religion, disability, gender, age, or sexual orientation.
Minor Exploitation: Nalva is strictly 18+. Any upload, solicitation, or engagement involving minors or child sexual abuse material (CSAM) results in immediate permanent ban, IP blocking, and immediate referral to federal law enforcement authorities and NCMEC.
Impersonation & Phishing: Impersonating any individual or entity, falsely claiming affiliation with Nalva, or distributing deceptive phishing links or malware.
Technical Tampering: Attempting to probe, scan, or compromise our server infrastructure, circumvent account bans, or inject malicious code, scripts, or automated scraping scrapers.
8. UGC Moderation, In-App Reporting & Blocking (Apple Guideline 1.2)
In strict compliance with Apple App Store Review Guideline 1.2 (User-Generated Content), Nalva integrates built-in protective features to maintain community health:
Mandatory Agreement: You must accept these Terms prohibiting objectionable content and abusive conduct before sharing content or participating in community forums.
Instant In-App Reporting: Every outfit post, styling collage, and comment features an accessible "Report" trigger. Users can flag objectionable content and select report categories (e.g., Harassment, Inappropriate Media, Spam, Impersonation).
Real-Time User Blocking: Users possess the unilateral ability to block abusive or unwanted creators directly from their profile card or post menu. Blocking immediately conceals the offending user's content, halts communications, and hides your outfits from their feed.
24-Hour Moderation SLA: All flagged reports are ingested into our trust and safety workflow and evaluated by human moderators within twenty-four (24) hours. Content identified as violating our Terms is promptly removed, and the offending user's account will be restricted or permanently banned.
9. Apple App Store Minimum Terms & EULA
If you downloaded Nalva from the Apple iOS App Store, you acknowledge and agree that this Agreement is between you and Nalva only, and not with Apple Inc. ("Apple"):
Apple Not Responsible: Apple is not responsible for the App, its content, maintenance, support, warranty, or the investigation and defense of any third-party intellectual property infringement claims.
Maintenance & Support: Nalva is solely responsible for providing maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish any maintenance or support services.
Product Claims: Nalva, and not Apple, is responsible for addressing any claims of the user or any third party relating to the App or the user's possession and/or use of that App, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
Third-Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
App Store Usage Rules: Your license to use Nalva is conditioned upon your compliance with the Apple Media Services Terms and Conditions.
10. In-App Purchases, Digital Presets & Billing
If Nalva offers optional premium features, virtual styling packages, preset packs, or tiered subscriptions:
Apple StoreKit Billing: All financial transactions, billing cycles, renewals, and payments are executed securely and exclusively through Apple In-App Purchase (IAP) via your Apple ID.
Auto-Renewable Subscriptions: Subscriptions renew automatically unless cancelled at least 24 hours prior to the conclusion of the active subscription period. You may manage or cancel your subscription at any time via your iOS device Settings > Apple ID > Subscriptions.
Refund Policy: All billing, chargebacks, and refund requests are governed by Apple's Media Services Terms and Conditions and processed directly through Apple Support. Nalva does not directly process or store your payment card credentials.
11. DMCA & Intellectual Property Takedown Policy
Nalva respects intellectual property rights and adheres to the notice-and-takedown procedures of the Digital Millennium Copyright Act (17 U.S.C. ยง 512) and international copyright legislation. If you believe your copyrighted outfit photographs, graphic assets, or designs have been uploaded to Nalva without authorization, please submit a written notification containing:
A physical or electronic signature of the copyright holder or authorized representative;
Identification of the copyrighted work claimed to have been infringed;
Specific identification and URL/link or in-app screenshot showing the infringing material to be removed;
Your contact information (name, email address, telephone number);
A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law; and
A statement made under penalty of perjury that the information in the notification is accurate and that you are authorized to act on behalf of the owner.

12. Disclaimer of Warranties ("As Is")
WARRANTY DISCLAIMER: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NALVA AND ALL ASSOCIATED SERVICES, FEATURES, PRESET GRAPHICS, AND COMMUNITY CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT: (A) THE SERVICES WILL FUNCTION UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) ANY DEFECTS OR SYSTEM BUGS WILL BE CORRECTED; OR (C) THE OUTFIT RECOMMENDATIONS OR USER POSTS WILL MEET YOUR STYLING EXPECTATIONS.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL NALVA, ITS DEVELOPERS, AFFILIATES, OPERATORS, DIRECTORS, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, GOODWILL, DEVICE DAMAGE, OR SERVICE INTERRUPTION) ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES, OUTFIT PRESETS, OR COMMUNITY INTERACTIONS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO NALVA FOR THE SERVICES DURING THE SIX (6) MONTHS PRECEDING THE CLAIM, OR FIFTY U.S. DOLLARS ($50.00 USD), WHICHEVER IS GREATER.
14. Indemnification
You agree to defend, indemnify, and hold harmless Nalva, its operators, contributors, licensors, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or legal fees arising out of or relating to: (a) your violation of these Terms; (b) your User-Generated Content (including claims of copyright infringement, privacy violations, or defamation); (c) your violation of any third-party rights; or (d) your conduct in connection with the App or other community members.
Upon confirmation, your profile, outfit uploads, styling collages, and presets are delisted immediately and permanently purged from active production databases in accordance with our Privacy Policy.
15.2 Suspension & Termination by Nalva
We reserve the right, without prior notice or liability, to suspend, freeze, restrict, or permanently terminate your account if: (a) you violate any provision of these Terms or our Community Guidelines; (b) you are found to be under 18 years old; (c) your conduct poses legal risk, security vulnerabilities, or harm to the community; or (d) required by legal or regulatory mandates.
16. Governing Law & Dispute Resolution
These Terms and your use of Nalva shall be governed by and construed in accordance with the laws of your applicable regional jurisdiction, without regard to conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the breach thereof shall first be submitted to good-faith informal negotiation by contacting service@nalva.org before initiating any formal arbitration or judicial proceedings.
17. Severability & Entire Agreement
These Terms, together with our Privacy Policy and any applicable supplemental in-app guidelines, constitute the entire agreement between you and Nalva regarding the use of the App, superseding any prior understandings or written agreements.
If any provision of these Terms is deemed unlawful, invalid, void, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and deemed severable from the remaining provisions, which shall continue in full force and legal effect.
18. Amendments & Updates to Terms
We reserve the right to revise, update, or replace these Terms at our discretion as our styling tools evolve, community scales, or legal requirements change. When modifications are made, we will update the "Last Updated" timestamp at the top of this document.
If modifications are material, we will provide conspicuous advance notice through in-app pop-ups or message alerts before the new Terms become active. Your continued use of Nalva after any revision enters into effect establishes your acceptance of the revised Terms.
